Israeli Torture of Palestinian Minors

Isma'il Sabatin's story of torture began on Tuesday November 14, 2000 around midnight when he was arrested by Israeli soldiers. Isma'il is 17 years of age who lives with his family in Hussan village near Bethlehem. Isma'il with two other children brought out their testimonies about their personal hardship in the Israeli Gush Etzion police station in a press conference held at the premises of the Palestine Media Center on July 18, 2001. Mr. Mohammed Abu Harthieh, Director of Al-Haq Institute, elaborated on how these violations of International Law on Palestinian accounts reinforce the necessity to provide the Palestinian people with international protection.

"The interrogators ordered me to get into a position with my legs up and my head down while I was leaning on the wall. They left the room and ordered me to stay there until they returned. Later, they stood me on a chair and told me to grab a pipe that was fixed to the wall. They removed the chair from under me and left me hanging in the air, with my handcuffed hands holding onto the pipe and the weight of my body, hanging in the air, and drawing my hands downwards. They left the room." Isma'il said.

Another testimony was from Ibrahim Za'ul, 16years, who was tortured in the same prison:
They brought me to another room. Inside, was an officer who identified himself as "Ayoub." He said that he is a merciless person and is ready to kill me if I don't tell him the name of the youths who threw stones... Another guy opened the door and said in Arabic that Ahmad Aref Sabatin had died during interrogation. The officer turned to me and said, "What are we going to do with the body of Ahmad Sabatin, what do you say Ibrahim, what do you think? Do you want to change places with Ahmad? [...] I was blindfolded. The interrogator said that he was going to electrocute me and that I would die like Ahmad. I felt the sensation of two iron wires being stuck on me, but nothing happened... I was taken to the room where Ahmad Sabatin was. The interrogators began to beat him right in front of me. Ahmad began to cry and scream. I asked them to stop because Ahmad did not throw stones, and I told them that I was ready to confess that I was the one who threw stones."
The number of Palestinian minors held in Israeli prisons exceeds 100, all of whom were subjected to various types of torture. In the past 10 months 35 children under the age of 18 were arrested from the village of Hussan.

"Article 47 of the convention of the rights of the child-1991 prohibited any kind of psychological or physical pressure against minors. They should be tried before a civilian court, the violations in their case are not merely torture, but violations of all due process, of all guaranteed rights of a fair treatment from the moment of arrest to the moment of release." Abu Harthieh said.

"The Israeli government continues its violations of International Law and continues to torture Palestinian detainees. Israel is diluting the International opinion through the Supreme Judicial Court's statement that torturing has stopped. In its practice, Israel violates its own laws passed in its Supreme Court in 1998. Its obligation under the convention of covenant of civil and political rights, prohibits any kind of torture" Abu Harthieh continued.

About the children who were tortured Al Haq director stated, "I was very pleased to hear they were courageous and were released before any permanent disability".

Common difficulties that face the Humanitarian Organizations, which prohibited torture in 1949 in article 31 considering it a grave breach, are: -The forgery in Medical reports of tortured Palestinians stating that they are intact from injury and torture. -Israeli officials lie about the torturing of detainees -The organizations are not able to address these matters except after they have already occurred.  

These actions such as spending a night of interrogation under torture are not isolated cases nor are they uncommon conducts committed by certain Israeli police officers. They are in fact methods of torture adopted at the Israeli police stations and used against dozens of Palestinian detainees.
